§ 3-3. Animals—Creation of offensive conditions.

  • It shall be unlawful and constitute a nuisance for any person to own, maintain or otherwise keep any animal or livestock or to maintain the place in which the animal or livestock is kept in a manner that creates an offensive condition in the vicinity thereof. An offensive condition is created when noises, odors, aromas, dust, waste, insects or vermin are created, emitted or given off so as to be offensive, disturbing, repulsive or obnoxious to the senses any person in the vicinity of the animal or livestock. In addition to any other penalty provided for in this Code, the municipal court shall have the jurisdiction and the authority to abate any such nuisance by requiring that the conditions in which animals are kept be changed or amended so as to eliminate or mitigate the offensive condition, including but not limited to a requirement for the reduction of the number of animals or livestock that may be kept on any property.
