§ 7-7. Use of neighborhood electric vehicles within the town.

  • (a)

    The use of neighborhood electric vehicles within the town is authorized and allowed, subject to the restrictions and limits contained herein.

    (b)

    For purposes of this section, a neighborhood electric vehicle is defined as a vehicle:

    (1)

    Which is propelled by an electric motor;

    (2)

    Which meets the equipment standards set forth in article 1, part 2, of the model traffic code or in any other code accepted by the State of Colorado;

    (3)

    Is designed to carry four or fewer persons;

    (4)

    Is designed to be operated at speeds of 25 miles per hour, or less;

    (5)

    Has at least four wheels in contact with the ground; and

    (6)

    Has an unladen weight of less than 1,800 pounds.

    (c)

    Neighborhood vehicles operating within the town shall be subject to the following regulations:

    (1)

    No person shall operate a neighborhood electric vehicle on a limited access highway.

    (2)

    No person shall operate a neighborhood electric vehicle on any street or highway with a posted speed limit of more than 30 miles per hour; provided however, that neighborhood electric vehicles shall be allowed to cross, at intersections, streets that have a posted speed limit in excess of 30 miles per hour.

    (3)

    Neighborhood electric vehicles shall not be operated at a speed in excess of 25 miles per hour.

    (4)

    Neighborhood electric vehicles shall not carry a greater number of persons or carry a greater load than that specified by the manufacturer. The driver and all passengers must be seated in seats substantially similar to those placed in the vehicle by the manufacturer.

    (5)

    No person shall operate a neighborhood electric vehicle on a city owned or maintained trail.

    (6)

    Neighborhood electric vehicles shall only be operated by persons holding a valid drivers license.

    (7)

    Operators of neighborhood electric vehicles shall obey all traffic laws of the State of Colorado, including but not limited to, laws concerning financial responsibility, and all traffic laws and regulations of the United States of America.

    (8)

    All persons operating a neighborhood electric vehicle within the town shall comply with any provisions of state law related to the registration of such vehicles and the license plate issued by the state shall display on that vehicle at all times.
