§ 15-86. Water rights; subdivision; annexations.
The town, as part of its subdivision approval procedures, shall require any person who proposes to annex property to the town or to subdivide property already within the town limits or both, to transfer to the town all or part of the water rights owned by such person on such property and/or may require such person to pay on such property and/or may require such person to pay to the town a plant investment fee required for the expansion of the existing waterworks facilities or the acquisition of additional water rights. Such requirements shall be imposed by the town based on recommendations provided to the town by the town engineer concerning the amount of water necessary to serve the proposed subdivision, any expansion of existing waterworks facilities that will be required to serve the proposed subdivision or additional water rights that will be required to serve the proposed subdivision. The town shall require such water rights, even though sufficient water rights already exist to serve the proposed subdivision, as are necessary to maintain the same ratio of water rights to persons served as currently exists.
