§ 13-42.5. Location of improvements and priority of use.

Any person seeking an excavation permit shall be required to submit a plan specifying the proposed location of improvements, the size of any lines to be installed, and the location of the proposed improvements in relation to existing utilities or other improvements. The town's public works director shall have the authority to specify the location of any proposed improvements within the right-of-way to assure the orderly use of the rights-of-way within the town, to avoid damage and to assure that space will be available in the right-of-way for additional utilities or other future improvements. In the event a conflict exists between intended uses, any proposed use by the town shall be given priority.
